01Who provides the service
ProspectScouter is provided by the administrator of the prospectscouter.com service ("we", "us"). "You" means the business or person that creates an account, and "users" means the people you allow to use your account. You can reach us at [email protected].
ProspectScouter is a business service. You confirm that you use it for business purposes, that you are at least 18 years old and that you have authority to accept these terms for your business. Our privacy policy explains how we handle personal data and forms part of these terms. Enterprise customers may sign an order form or data processing agreement, which takes precedence over these terms where they conflict.
02Creating and protecting your account
You sign up with a work email and a password and confirm the email with a code we send to it. Keep your information accurate, keep your password and codes private, and make sure each seat is used by one named person. Seats may not be shared. You are responsible for activity in your account and for the users you invite, and you must tell us promptly at [email protected] if you suspect unauthorized access.
03The one-time demo report
The homepage offers one demo report without an account and without a card. It shows a scouting report for one target company, with some sections locked. The demo is provided as is, may be limited per visitor and per day, and is a one-time look at the product, not a trial of a paid plan. We may change or withdraw the demo at any time.
04Plans, billing and renewal
Paid use of ProspectScouter requires a subscription to one of the plans shown on the pricing page: Starter, Growth, Scale or Enterprise. Each plan includes the seats, monthly limits and features listed there at the time you subscribe.
- You choose monthly or yearly billing. Subscriptions renew automatically for the same period until cancelled.
- Fees are charged in advance for each period to the card you provide, through our payment processor. We do not store full card numbers.
- Prices are in US dollars and exclude taxes, which are added where the law requires.
- If a payment fails, we may retry it, notify you and suspend paid features until the balance is paid.
- Upgrades take effect immediately, with the price difference for the current period charged or prorated as shown at checkout. Downgrades take effect at the next renewal.
- We may change prices for future periods with at least 30 days' notice by email. The new price applies from your next renewal, and you can cancel before it does.
- Enterprise plans are billed monthly or yearly like other plans and may also be paid by invoice and purchase order.
Every plan is paid. There is no credit system and no one-time purchase.
05Usage limits and resets
Each plan has a monthly allowance of scouted accounts and verified contacts and a number of seats and ICPs. Allowances reset at the start of each monthly cycle, including on yearly plans, and unused amounts do not carry over. When you reach a limit, you can wait for the reset or upgrade. We may apply fair-use measures, such as rate limits, to protect the service for all customers.
06Cancelling and refund policy
You can cancel at any time in your account settings or by writing to [email protected]. Cancellation stops the next renewal. Your access continues until the end of the period you already paid for, and then the account moves to an inactive state.
- If you are charged for a renewal you did not intend and you have not used the service in that new period, write to us within 14 days of the charge and we will refund it.
- If the service is unavailable for a significant part of a paid period because of a fault on our side, we will offer a proportional credit or refund.
- Otherwise, fees for periods that have started are not refundable, except where the law requires a refund.
Before an account is closed, you can export your boards, reports and contacts as CSV within your plan limits.
07Rules for using ProspectScouter
ProspectScouter is for lawful, relevant business-to-business outreach. You agree that you and your users will not:
- Send spam, bulk unsolicited messages or misleading messages using data or openers from the service.
- Break the CAN-SPAM Act, including its rules on accurate headers, honest subject lines, a valid postal address in commercial email and prompt handling of unsubscribe requests.
- Break the GDPR, the UK GDPR, the CCPA and CPRA, Canada's anti-spam law or other privacy and marketing laws that apply to your outreach.
- Break the Telephone Consumer Protection Act or do-not-call rules when calling or texting, including rules on autodialed calls and prerecorded messages.
- Break the terms of LinkedIn or any other platform you use to contact people, including limits on automated activity.
- Contact anyone who has opted out, or fail to honor an opt-out you receive.
- Use the service to research individuals for consumer, employment, credit, insurance, housing or tenancy decisions, or for any purpose covered by the Fair Credit Reporting Act.
- Harass, stalk or discriminate against anyone, or target people based on sensitive characteristics.
- Resell, publish or bulk redistribute data from the service, or use it to build a competing database or product.
- Scrape, copy or reverse engineer the service, bypass limits or access controls, or overload it.
- Upload malware or content you have no right to use.
You are responsible for the messages you send and for having a lawful basis to contact the people you reach. We may suspend accounts that break these rules.
08Your data stays yours
Customer data means the information you provide or connect to the service, such as your website, ICP definitions, lists of best customers, CRM records, notes and edits to openers. You keep all rights in your customer data. You give us permission to use it only to provide, secure and support the service for you. We do not sell your customer data or share it with other customers. You confirm that you have the rights and any notices or consents needed to share customer data with us. Where we process personal data in your customer data, we act as your processor, and Enterprise customers can sign a data processing agreement.
09Reports, contacts and our rights
The service, its software, design and research format, and the company and business contact data we compile from public sources and licensed providers belong to us or our licensors. During your subscription we grant you a limited, non-exclusive, non-transferable right to use reports, contacts and openers for your own internal B2B sales and marketing. Data you exported while subscribed may remain in your CRM after the subscription ends, provided you keep honoring opt-outs and applicable law and do not redistribute it. If a person asks us to remove their data and tells us they have been contacted through the service, we may ask you to stop using their data.
Feedback you send us may be used to improve the service without obligation to you.
10API access and connected tools
API access is available on Scale and Enterprise. API keys are confidential, must be stored securely and may be used only for your own account. We may set rate limits and change or retire API versions with reasonable notice. Integrations with HubSpot, Pipedrive, Salesforce, Slack and other tools rely on those third-party services and their terms, and we are not responsible for changes they make. See integrations for the current list.
11Availability and support
We work to keep ProspectScouter available at all times, but the service may be interrupted for maintenance, updates or events outside our control. Except for an Enterprise SLA of 99.9 percent agreed in writing, we do not promise a specific uptime. Support is provided by email at [email protected], with a typical reply within one business day. We may improve, change or remove features, and we will not materially reduce the core features of a paid plan during a period you have already paid for.
12When access can be suspended or ended
We may suspend or end access if you break these terms, fail to pay, create a security or legal risk, or if required by law. Where reasonable, we will notify you first and give you a chance to fix the issue. You may end the agreement at any time by cancelling. Sections that by their nature should survive, such as acceptable use, data rights, disclaimers, limitation of liability and governing law, continue after termination.
13What we do not guarantee
Reports, fit grades, buying signals, contacts and openers are produced with AI from public sources and licensed providers and may contain errors, gaps or outdated information. Each signal links to its source so you can check it. Contact details are verified before export, but we do not guarantee that every email address or phone number is valid or reaches the intended person. We do not guarantee meetings, replies, revenue or any business result. You are responsible for reviewing content before you send it. Except as stated in these terms, the service is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows.
14Limits on liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for all claims relating to the service in any twelve-month period is limited to the fees you paid us for the service in the twelve months before the event giving rise to the claim. These limits do not apply to your payment obligations, to breaches of acceptable use, or to liability that cannot be limited by law.
You agree to defend and indemnify us against claims by third parties arising from your outreach, your customer data or your breach of these terms.
15Governing law and disputes
These terms are governed by the laws that apply at the administrator's place of establishment, without regard to conflict of law rules, unless mandatory consumer or data protection law of your country provides otherwise. Before starting any formal dispute, both sides agree to try to resolve it in good faith by email for at least 30 days. Consumer protection rules that cannot be waived under the law of your country still apply where relevant.
16Changes to these terms
We may update these terms as the service or the law changes. We will post the new version on this page with a new date and, for material changes, notify account holders by email at least 30 days before they take effect. If you continue to use the service after that date, the new terms apply. If you do not agree, you can cancel before the change takes effect. Questions about these terms go to [email protected].
